BRT: Court adjourns Bamise hearing to February 8

A Lagos State High Court has adjourned the hearing for the ‘No Case Submission’ filed by Andrew Ominnikoron, a Bus Rapid Transit (BRT) driver on trial over the alleged rape and murder of Oluwabamise Ayanwola on Thursday, February 8, 2024.

Justice Sherifat Sonaike, who had initially scheduled Tuesday for the adoption of the application, was compelled to adjourn the case.

This decision came as a result of the failure of the defence counsel, Abayomi Omotubora, to serve the prosecution with a copy of the No Case Submission application.

According to the prosecution, the defendant allegedly raped a 29-year-old lady, Nneka Maryjane Ozezulu, on November 25, 2021, around the Lekki-Ajah Conservation Centre on the Lekki-Ajah Motorway, Lagos.

Martins also claimed that Ominnikoron conspired with others to forcefully have sexual intercourse with his 22-year-old passenger, Oluwabamise Ayanwola, before allegedly throwing her out of a moving bus at Carter Bridge on February 26, 2022.

Ominnikoron, however, pleaded not guilty to the charge.

The prosecutor, Mohammed Olateju, informed the court on Tuesday that the defence counsel had not served the prosecuting team with a copy of the No Case Submission application.

In response, Omotubora admitted that the application filing was incomplete, stating, “We need a little time to meet filing. All that is left to be done is just scanning, which will be done as soon as possible.”

Upon consideration of the situation, Justice Sonaike adjourned the matter to February 8 for the adoption of the ‘No Case Submission’ application.
