A Federal High Court sitting in Abeokuta has directed the Independent National Electoral Commission(INEC) to expunge the name of Barr. Biyi Otegbeye as governorship candidate of all African Democratic Congress (ADC) in Ogun State.

The court held that the process that threw Otegbeye up as a governorship candidate did not satisfy the electoral law requirements.

The presiding Judge, Justice Adetayo Aluko also ordered the Independent National Electoral Commission (INEC) to expunge Otegbeye’s name from its website in respect of the 2023 governorship election.

The same Court also nullified House of Assembly primaries of ADC and the outcome, saying the primaries violated electoral law.

The judgement followed the suit brought before the court by the All Progressives Congress(APC) against the ADC and INEC, where the party sought five grounds for determination by the court but the case brought adverse consequence on Otegbeye was filed by Labour Party.

Justice Aluko in his judgement held that since the 3rd defendant(INEC) agreed that it did not monitor the ADC primaries, the action violates the electoral act and the Constitution.
